03/13.06.2025       Heard Mr. Ankit Apurva, learned counsel appearing for the

appellant and Mrs. Nehala Sharmin, learned Spl.P.P.
This application has been preferred by the appellant for grant of
bail to him during pendency of the appeal.

The appellant has been convicted for the offence punishable
under Section 302/34, 120B of I.P.C and has been sentenced to undergo
rigorous imprisonment for life with a fine of Rs.20,000/- for the offence under
Section 302/34 of I.P.C.

It has been alleged that there was scuffle between the son of the
informant who was working in an under-construction library building in
RIMS, Ranchi with the appellant and after the said incident, his son was
found fallen down from the roof and though he was admitted to the Hospital,
but he subsequently succumbed to his injuries.

Submission has been advanced by learned counsel for the
appellant that only on account of an allegation that there was a scuffle
between the appellant and the deceased, he has been roped in the present case.
It has further been submitted that one of the co-convict who was present at the
place of occurrence namely Md. Amzad Ansari @ Md. Amjad has been
granted bail by this Court in Cr. Appeal (DB) No.1207 of 2024. It has further
been submitted that only witness of substance is P.W.11 who has stated about
the presence of the appellant as well as Md. Amzad Ansari along with the
deceased when the incident had taken place.

Learned Spl.P.P has opposed the prayer for bail of the appellant.
Regard being had to the fact that one of the co-convict almost
similarly situated has been granted bail by this Court, we are inclined to admit
him on bail. Accordingly, the appellant above named is directed to be released
on bail during pendency of the appeal on furnishing bail bond of Rs.10,000/-
(Ten thousand) with two sureties of the like amount each, to the satisfaction of
learned Additional Judicial Commissioner-VIII, Ranchi in connection with
Sessions Trial No.265 of 2021.

I.A. No. 6601 of 2025 stands allowed and disposed of.
