Heard learned counsel for the petitioner and learned
APP for the State.
2. The petitioner apprehends his arrest in connection
with Complaint Case No. 1651 of 2023 initially registered for
the offence punishable under Sections-147, 148, 149, 323, 379,
498(A), 504 of the Indian Penal Code and later on, cognizance
has been taken against the petitioner for the offence punishable
under Sections-323, 341, 498(A) and 504 of the Indian Penal
Code as well as ¾ of Dowry Prohibition Act.
3. As per complaint, the marriage of the complainant
with the petitioner took place 11 years ago. After two years of
the marriage, the accused persons including the petitioner

started demanding cash Rs. two lacs as dowry and due to non-
fulfillment of the same, they started torturing the complainant
and consequently, the complainant with her children was ousted
from her matrimonial home.
4. Learned counsel for the petitioner has submitted
that it is a case of matrimonial dispute. The petitioner is husband
of the complainant. The matter was referred to Patna High Court
Medication and Conciliation Centre, where the parties appeared
and compromised the case. The terms and conditions of the
compromise has been attached with the record.
5. From perusal of terms and conditions annexed with
the Mediation Report entered into between the parties, it appears
that the petitioner agrees to keep his wife (the complainant)
along with the children with full honour and dignity. It was also
agreed upon that the family members of both the parties shall
not interfere into their personal life and after spending conjugal
life cordially with each other for six months, the parties shall
file compromise petition in the present case.
6. Considering the aforesaid facts and circumstances,
let the petitioner named above, in the event of arrest/surrender
within four weeks before the court below be released on bail on
furnishing bail bond of Rs. 10,000/- (ten thousand) with two

sureties of the like amount each to the satisfaction of learned
Judicial Magistrate-Ist Class/concerned court, Banka in
connection with Complaint Case No. 1651 of 2023 subject to
the conditions as laid down u/S 438(2) of the Cr.P.C.
