[1] Heard Mr. S. Rupachandra, learned senior counsel
assisted by Mr. Shahidur Rahman, learned counsel for the petitioner
and Mr. Y. Ashang, learned PP assisted by Mr. Phungyo Zingkhei,
learned Dy. G.A. for the State respondent.
[2] By the present application, the petitioner approached this
Court for releasing on bail in connection with FIR No. 01(02)2024 NAB-
PS U/S 22(c)/25/60(3) of ND&PS Act, 1985.
[3] From the record, it is seen that the Special Court (ND&
PS), Manipur and also this Court earlier rejected the bail application on
medical ground as well as on merit.
[4] Since learned senior counsel for the petitioner confines to
the prayer for releasing the petitioner on interim bail for medical

treatment, medical report is called for and the medical report dated
24.04.2025 is submitted by the Superintendent of Police, Manipur
Central Jail, Sajiwa. As per the opinion of the Sr. Medical Officer,
Manipur Central Jail, Sajiwa, the petitioner has the problem of bleeding
due to haemorrhoids along with other ailments and is of the opinion
that the same cannot be controlled in MI room in jail and advised for
surgical treatment.
[5] Learned senior counsel for the petitioner submits that
three months time may be granted for medical treatment.
[6] On the other hand, learned PP submits that one month
time may be sufficient for the petitioner to take surgical operation.
[7] Considering the latest medical report dated 24.04.2025,
the petitioner is released on interim bail for two months for taking
medical treatment especially for hemorrhoids and other related
complaints. On expiry of two months, the petitioner shall surrender to
the Superintendent, Manipur Central Jail, Sajiwa and a copy of the
proof of surrender shall be furnished to the Ld. Special Court (ND &
PS), Manipur and this Court.
[8] In the circumstances, the petitioner is directed to be
released on interim bail for two months to the satisfaction of the Ld.
Spl. Judge (ND & PS), Manipur on furnishing a bail bond of Rs.
50,000/- with a surety (Govt. Employee) each of like amount subject to
the conditions:

(a) The petitioner shall furnish personal bond
of Rs. 50,000/- (Rupees Fifty Thousand)
with one surety (Govt. Employee) of the
like amount.
(b) The petitioner shall co-operate with the
investigation.
(c) The petitioner shall not tamper with the
evidence or influence witnesses.
(d) The petitioner shall not leave Manipur
without permission of this Court.
(e) On breach of any of the aforesaid
conditions, the respondent is entitled to
take appropriate action against the
petitioner in accordance with law.
[9] The petitioner shall surrender before the
Superintendent, Manipur Central Jail, Sajiwa on expiry of two months
from the date of release. A copy of proof of surrender shall be
forwarded to this Court and learned Special Judge (NDPS), Manipur.
[10] List this case on 18.07.2025.
[11] Send a copy of this order to the learned Spl. Judge (ND
& PS), Manipur for information and necessary action.
