1. Heard learned counsel for the
parties and perused the pleadings.
2. The petitioner is involved in a
case under Sections 120-B, 302, 34 of
the Indian Penal Code read with
Sections 3 and 25 of the Arms Act and
Sections 135 and 37(1) of the
Maharashtra Police Act, 1951 pursuant
to FIR No.788 of 2021 registered at
P.S. Bharti Vidyapeeth, District Pune
Town.
3. Out of the four accused, three
other accused including the accused who
was found in possession of fire arm and
is alleged to have opened fire, has
been granted bail.
4. The petitioner was arrested on
06.12.2021 and has undergone sentence
of about three years and eight months.
5. We are informed that recently
charges have been framed but the trial
has not commenced.
6. In view of the aforesaid facts and
circumstances of the case, we deem it

appropriate to enlarge petitioner on
bail.
7. Accordingly, the petitioner is
directed to be released on bail subject
to such terms and conditions as may be
imposed by the trial Court
commensurating with the charges framed
against him.
8. Needless to state that the
petitioner shall cooperate and
participate in the proceedings as and
when required.
9. The Special Leave Petition is
disposed of accordingly. Pending
application(s), if any, shall stand
disposed of.
