Heard the parties.
The petitioner has moved this Court for grant of bail in
connection with Muffasil P.S. Case No.265 of 2023, N.D.P.S. Case
No. 36 of 2023 registered for the offences punishable under
sections 413/414/279/427/34 of the Indian Penal Code and under
Section 21(b)/21(c)/22(b)/22(c) and 29 of the N.D.P.S. Act.
The learned counsel for the petitioner submits that the
allegation against the petitioner is that the petitioner is the owner
of the vehicle from which 1 Kg of opium and Rs.4,000/- cash was
recovered. It is further submitted that the allegations against the
petitioner are all false and the alleged opium seized comes under
intermediary quantity. It is next submitted that the petitioner sold
the vehicle to one Naushad Alam on 15.05.2023 for which an
agreement was entered into between the parties but the ownership
of the vehicle has not been transferred in the name of Naushad
Alam in the District Transport Office. It is then submitted that the
petitioner has no criminal antecedent as has been mentioned in
para -27 of the bail application. It is next submitted that the
petitioner has been in custody since 08.05.2025, as has been
mentioned in paragraph no. 26 of the bail application. It is further
submitted that the petitioner undertakes to cooperate with the trial
of the case. Hence, it is submitted that the petitioner be admitted to
bail.
