1. Quashing of proceedings in case titled as”Parveena Akhter v.

Mohammad Lateef Hakeem,”pending before the Court of Judicial

Magistrate, Pampore, is sought for in this petition.

2. Having regard to the relief claimed in this petition, it is not
maintainable as the proceedings pending before the Trial Court under
Section 125 Cr.PC, in which admittedly order for maintenance has been
passed, is not being complied with by the petitioner, therefore, the Trial
Court has taken steps to get it implemented.

3. Learned counsel for the petitioner submits that petitioner is ready to pay
the maintenance, but he could not pay it in lump sum. He further
submits that petitioner may be permitted to make an application in this
regard before the Trial Court.

4. Having regard to the submissions made by learned counsel for the
petitioner, the present petition is disposed of with a direction to the
Trial Court that in the event petitioner makes an application before it,
same shall be considered strictly in accordance with law.

5. Disposed of as above.
