23.09.2024 whereby the High Court rejected the
regular bail application filed by the appellant.
4. The appellant was initially not named in
the FIR, however, he was arrested on 25.02.2022.
Thereafter, the first charge-sheet came to be
filed on 25.03.2022, only in the supplementary
charge-sheet of 24.05.2022 he has been named for
the alleged offences. The appellant has been in
custody since 25.02.2022 in connection with FIR
No.343 dated 11.12.2021 registered at Police
Station Division B, Police Commissionerate
Amritsar filed under Sections 307, 302, 34, 108,
120-B, 111, 112, 201 of the Indian Penal Code and
Sections 25 and 27 of the Arms Act, 1959.
5. Heard the learned counsel appearing for the
parties.
6. Having considered the matter in detail and
taking note of the fact that the appellant has
already undergone incarceration of more than 3
years, and the fact that there is no likelihood
of the trial being concluded in the near future,

we consider it appropriate to release the
appellant on bail subject to such terms and
conditions as may be imposed by the Trial Court.
7. We make it clear that the appellant shall
fully cooperate with the investigation. In case
the appellant does not cooperate with the
investigation, State is at liberty to move the
Trial Court for cancellation of bail.
8. The appeal is accordingly allowed.
