This Criminal Petition, under Sections 480 and 483 of the
Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by
the petitioner/A4, seeking regular bail, in Crime No.382 of 2024
df Kancharapalem Police Station,- registered for the offences

punishable under Sections 109, 308(5), 318(4), 131,127(2),
351 (2) and 61 (2) of the BNS and Section 67-A of the lT Act.

2. Case of the prosecution, in brief, ‘ls that, on 05.10.2024,

the defacto complainan{ filed a `report before the police stating
that he is a resident of Adreddipalem, Sabbavaram, Anakapalli
and he had been running a Coffee Shop a{ VIsalakshi Nagar,
Visakhapatnam for the last two years in the name of WABI ART
CAFE. About six months prior to the occurrence of the offence,
Al visited his shop along with her friend Udaya (Navya) and

introduced herself as Digital Marketer and then told that they

imI’tate photos jn her mobJ’e, and on seelng them he was
shocked and questl’oned about the photos, but she skipped the
topl’c Thereafter, Al demanded hlm to glve dl’vorce to hls wl-fe
and also to brlng hl’s motherJs JeWellary a`hd cash and further she
locked him l’n room for two days and further threatened the
defacto complajnant to br,ng gold and cash and she also Invited
her frlends to hostage hlm and demand money from hIS Parents
As the defacto complalnan[ refused AIJs proposal, she broke a

glass bottle and attacked him to klll WhJIe, she was ln phone
conversa[I’On wJth a boy, the defac{o complalnant ran away from
her home on 29.07.2024.

4. Learned counsel for the petltJOner submltS that excep”he
confessIOna’ statement of co-accused, no other maten’al l’s
collected showlng the compltclty of the petjtIOner ln the present
crlme. He further subm,Its that the confessl’onal statement ,s not
admlsslb’e evldence and the petl{JOner here,n has been
langulshlng ln Ja” for more than 200 days He further submlts
that l’n order to overcome the statutory perl-od, the police filed

preljmI’nary charge sheet and as of now fl’nal charge sheet js not
yet fI-led.

5. on the other hand, learned Assistant public Prosecutor
submits that jn the present case, the pe{l-tjoner and his wife are
alleged to have done Honey Trap and extorted monl’es from the
victims. He further subml-ts that the laptops and other material
belonging to the petit,’oner herel-n were sent for analysis.

6. In view of the aforesal|d facts and circumstances of the
case and considering the remand perI-Od Of the Petl’tI’Oner, thI-S

court js I’nCIjned to grant bail to the petitl-oner/A4 on the following

COndI-lions.

i) The petitioner/A4 shall be released on ba” on hI-S
execut[-ng personal bond for Rs.25,000/- (Rupees Twenty Five
Thousand only) wI’th two Suretl-eS Of the ll’ke sum each to the
satl-sfactf-on of the learned vH Addjtl-onal Judjcl-aI Magistrate of

Fl-rst class, visakhapatnam.

Ii) On release, the petI’tiOner Shall appear before the
station House offI-Cer concerned, every day, between 10.00 AM
and 1.00 PM, till fI’ljng of the charge sheet.
