ORDER

01. The respondent No. 1 is Commissioner/Secretary to
Government, Revenue Department, UT of J&K.
02. This Court directs the respondent No. 1 to submit on
affidavit as to how many ‘Fards Intikhab Jamabandi’
came to be issued relatable to transfer of lands covered
by Government Order No. S-432 of 1966 dated
03.06.1966 in Kashmir Province, district/tehsil wise and
how many mutations on the basis of the sale
transactions relatable to the ownership vested in terms of

Government Order No. S-432 of 1966 dated
03.06.1966, came to be attested.
03. This Court is constrained to direct this direction unto the
respondent No. 1 in the face of the fact that the position
of law with respect to the status of ownership bestowed
by Government Order No. S-432 of 1966 dated
03.06.1966 stood settled long back by this Court in the
case “OWP No. 982/2015 titled as Mohdammad Akbar
Shah & Ors. Vs. State & Ors., decided on
31.05.2016,” on the basis of which in subsequent writ
petitions filed by similarly situated petitioners as under
came to be disposed of but directions not complied with
by the Revenue Officials :-

J&K Ors.
b) WP(C) No. 3249/2023, decided on
13.03.2024, titled as Puran Chand & Ors.

04. The UT of Jammu and Kashmir is said to have gone in
challenge and hold back of issuance of ‘Fard’ in favour of
the petitioners claiming the same for facilitating transfer.
05. Once the basic judgment passed by this Court has
attained finality without being challenged and has
become a precedent for the Co-ordinate Benches to follow
then judgments passed by Co-ordinate Benches cannot
be faulted on pretext of having been challenged without
the basic judgment being called in question and this is
what is being made to be understood to this Court as if
the legal challenge has been regionalized in Jammu Wing
but not in Srinagar Wing.
06. Let requisite be done by the respondent No. 1-
Commissioner/Secretary to Government, Revenue
Department, UT of J&K.
