The appellant proposes to challenge
the judgment and order dated 02.03.2024,
passed in Special Sessions Trial No. 136 of
2016, State of Uttarakhand Vs. Mukesh
Gupta, by the court of Special Judge, NDPS
Act, Udham Singh Nagar. By it, the
appellant has been convicted and sentenced
under Section 8/20 of the Narcotic Drugs
and Psychotropic Substances Act, 1985.
The appeal is delayed. A Delay Condonation
Application, IA No.1 of 2025, has been filed.
Heard.
According to the delay condonation
application, the appellant was totally
unaware of the legal remedy and limitation
period available to challenge the conviction.
He was wholly dependent on legal aid and
had no independent means or knowledge to
initiate or follow up on legal proceedings.
The appellant has been provided legal
aid assistance at the State expenses.
It is not objected to by learned State
Counsel.
Having considered, the Delay
Condonation Application is allowed.
The delay in preferring the appeal is
condoned.
Heard on admission.
Admit.
Let call for the LCR.
Let a paper book be prepared and
provided to learned counsel for the parties,
as per rule.
