01. The petitioner No.1 is wife of the respondent No.1.
The petitioner No.2 is minor daughter of the petitioner No.1 and
the respondent No.1.
02. The matrimonial relationship between the petitioner
No.1 and the respondent No.1 has run into rough waters which
constrained the petitioners to initiate proceedings under the
Protection of Women from Domestic Violence Act, 2005 before
the court of learned Judicial Magistrate, 1st Class, Tangmarg,
District Baramulla as at the relevant point of time the petitioners
were located residence-wise, though temporarily, within the
territorial jurisdiction of the Judicial Magistrate, 1st Class,
Tangmarg.
03. However, during the course of pendency of the said
proceedings, the petitioners are said to have shifted their residence
from Tangmarg to Srinagar and wherefrom the petitioners cite
their handicap in pursuing their proceedings under the Protection
of Women from Domestic Violence Act, 2005 before the court of
learned Judicial Magistrate, 1st Class, Tangmarg and, therefore,
seek transfer of the said proceedings to a court of competent
jurisdiction in District Srinagar.
04. Issue notice to the respondent No.1 only.
05. Registrar Judicial, Srinagar to issue summon to the
respondent No.1.
06. Service upon the respondent No.1 to take place
through Process Serving Agency of the learned Principal District
Judge, Baramulla.
07. In the meantime, send for the original record of the
case titled ‘Mst. Jabeena Akhter & Anr. V. Tanveer Ahmad
Wani & Anr.’, from the court of Judicial Magistrate 1st Class,
Tangmarg.
08. List again on 2nd of April, 2025.
