Heard learned counsel for the petitioner and learned APP
for the State.
2. The petitioner seeks bail in a case registered for the
offences punishable under Sections 341, 323, 498(A), 504, 34 of
the Indian Penal Code and Section ¾ of the Dowry Prohibition
Act.
3. The prosecution case in the FIR is that the informant
was married to the petitioner on 15.03.2018 and thereafter, the
petitioner along with other accused persons started demanding
dowry and also assaulted her due to non-fulfillment of the same.
4. Learned counsel for the petitioner submits that the
allegation levelled against the petitioner is totally based on
concocted facts and denies the marriage of the informant with
the present petitioner and in support of the same, he has also
brought on record the Voter ID Card of the informant, which has

been annexed as Annexure-P/2 to the petition, showing the
name of her husband as one Ravindra Kumar Yadav. Learned
counsel for the petitioner also draws the attention of this Court
towards the supplementary affidavit filed on behalf of the
petitioner bringing on record a joint compromise petition
showing compromise between the parties. It is next submitted
that the petitioner voluntarily surrendered on 12.02.2025 and
has been languishing in custody since then with no criminal
antecedent. Further, it is also submitted that charge sheet has
been submitted in the present case.
5. Learned APP for the State, however, opposes the prayer
for regular bail.
6. Considering the above-mentioned facts and
circumstances, the above named petitioner is directed to be
enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees
Ten Thousand) with two sureties of the like amount each to the
satisfaction of the learned Court below where the case is
pending/successor Court in connection with Bhairavsthan P.S.
Case No. 23 of 2022.
