IN THE HIGH COURT OF JHARKHAND AT RANCHI

                                                        Versus
The State of Jharkhand ... Opp. Party(s).
                                                        ------
CORAM : SRI ANANDA SEN, J.

——

For the Petitioner(s) : Mr. Kripa Shankar Nanda, Advocate.

For the State : Ms. Kumari Rashmi, A.P.P
                                                 ........

02/17.04.2025 This is an application filed by the petitioner praying for grant of

anticipatory bail in terms of Sections 482 and 484 of the Bhartiya Nagrik Suraksha
Sanhita (BNSS), 2023, as the petitioner has been allegedly implicated in a criminal
case registered under Section(s) 303(2)/317(5) of IPC and under Section 21(6) of the
Mines and Minerals (Development & Regulation) Act, 1957 and under Sections 4/54 of
Jharkhand Minor Minerals Concession Rule 2004 and under Section 7/9 of Jharkhand
Minerals (Prevention of illegal Mining Transportation and Storage) Rule, 2017 in
connection with Gumla P.S. Case No. 262 of 2024, pending in the Court of learned
CJM, Gumla.

Heard learned counsel for the petitioner(s) and learned APP for the State
at length and had gone through the documents, annexed along with this application.

Opportunity was given to the State to oppose the bail, which the State
availed and opposed.

There is nothing in the petition to suggest that the petitioner is
apprehending arrest in this case. Thus, I am not inclined to entertain this application.
The petitioner is directed to surrender before the Trial Court and seek regular bail
which shall be considered by the said Court strictly in compliance of the guidelines laid
down in the case of Satender Kumar Antil Vs. Central Bureau of Investigation &
Another
, reported in 2022 (10) SCC 51 as well as the observation made in the case of
Satender Kumar Antil Vs. Central Bureau of Investigation & Another reported in
2024(9) SCC 198.

Accordingly, this application stands disposed of.
