1. The instant second bail application has been filed by the

petitioner under Section 483 BNSS who has been arrested in

connection with the FIR No.153/2024 dated 12.05.2024 registered

at the Police Station Kuchaman District Didwana-Kuchaman for the

offences under Sections 457, 380, 411 and 201 of IPC.

2. First bail application of the petitioner was dismissed as not

pressed and liberty was granted to the counsel to renew the

prayer for bail after filing of the charge-sheet. Now, the charge-

sheet has been filed.

3. Learned counsel for the petitioner submits that the petitioner

has been falsely implicated in this case while alleging that he

trespassed the dwelling house of the complainant and committed

theft of certain jewelry items. He further submits that the charge-

sheet has been filed and no recovery is due against the petitioner.

He also submits that the petitioner has 28 previous criminal

antecedents out of which, he is acquitted in 12 cases. Details of

the same are as under:-

Learned counsel for the petitioner also submits that the offences

alleged against the petitioner are exclusively triable by the Court

of Magistrate and thus, the petitioner deserves to be released on

bail.

4. Per contra, learned Public Prosecutor opposes the bail

application, however, is not in a position to refute the fact that the

offences are triable by the Magistrate, the fact that the charge-

sheet has been filed and the fact that out of 28 previous criminal

antecedents, the petitioner has been acquitted in 12 cases.

5. Having considered the submissions advanced at Bar by

learned counsel for the parties and having regard to the entirety

of facts and circumstances of the case as available on record; and

looking to the fact that trial may take a long time to conclude and,

without expressing any opinion on the merits/demerits of the

case, this Court deems it fit to enlarge the petitioner on bail.

6. Consequently, the instant second bail application is allowed.

It is ordered that the accused petitioner Munna S/o Imamuddin

arrested in connection with FIR No.153/2024 dated 12.05.2024

registered at the Police Station Kuchaman District Didwana-

Kuchaman shall be released on bail; provided he furnishes a

personal bond in the sum of Rs.50,000/- and two sureties of

Rs.25,000/- each to the satisfaction of the learned trial Court, with

a stipulation to appear before that Court on all dates of hearing

and as and when called upon to do so.
