01. 1. Heard learned counsel for the Petitioner and
learned counsel for the State.
2. The Petitioner is seeking pre-arrest bail in
connection with G.R. Case No.157 of 2011 pending in
the Court of learned J.M.F.C., Laxmipur arising out
Bandhugaon P.S. Case No.40 of 2011 for commission
of offence punishable under Sections 143/ 342/ 354/
323/ 379/ 147/ 149 of IPC.
3. Learned counsel for the State opposes the
prayer.
4. Taking into account the nature of allegations
which relates to the year 2011 and the age of the
Petitioner (65 years) and since charge sheet has
already been filed in the meanwhile, it is directed that
on surrendering within three weeks hence and moving
for bail, the Petitioner shall be released on bail by the
learned Court in seisin on such terms as deemed just
and proper.
