Heard learned counsel appearing on behalf of the petitioner.

This interlocutory application being IA No. 6583/2025 has been

filed seeking exemption from surrendering.

Petitioner was convicted under Sections 279, 338 and 304(A) of

the Indian Penal Code, 1860 (IPC) by the Court of Judicial

Magistrate No. 4, Tiruppur and was sentenced to undergo rigorous

Reason: (RI) for various periods, maximum being for six

months.

Appeal filed by the petitioner before the Court of

II Additional District and Sessions Judge, Tiruppur was dismissed

vide order dated 22nd January, 2022. Thereafter, petitioner filed

Revision Petition under Section 397 r/w Section 401 of the Criminal

Procedure Code, 1973 (Cr.P.C.) before the High Court of Judicature

at Madras, but the same was dismissed by order dated 30th August,

2024.

Learned counsel appearing on behalf of the petitioner submits

that all throughout the petitioner was on bail. On merit, he

submits that the petitioner has a good chance of success in the

related special leave petition.

On due consideration, petitioner is granted exemption from

surrendering.

The application is, accordingly, allowed.
