Leave granted.

Given the fact that the appellant, Naeem Khan Rahim Khan, has

already suffered pre-conviction incarceration for over three years

and as all other co-accused have been granted bail, we are of the

opinion that the appellant’s continued incarceration is no longer

warranted at this stage.

Accordingly, we accept the present appeal and direct that the

appellant, Naeem Khan Rahim Khan, shall be released on bail in

connection with Crime/First Information Report1 No. 133/2022 dated

21.06.2022 registered with Police Station – Dhanaj Shahpur,

District – Washim, Maharashtra, for offence(s) punishable under

Sections 143, 147, 148, 149, 307, 324, 504 read with Section 145 of

the Indian Penal Code, 1860, on appropriate terms and conditions to

be fixed by the trial court.
