Heard Mr. Mahender Thakur, learned counsel for the

appellant, Mr. Syed Ashfaque Ahmad, learned APP for the State and

Mr. Raju Kumar, learned counsel for the informant.

2. The instant interlocutory application has been filed

under section 389(1) of the Code of Criminal Procedure (in short

‘Cr.P.C.’) by the appellant for consideration of his prayer for

suspension of his sentence and release on bail during the pendency

of the appeal.

3. This appeal has been preferred against the judgment of

conviction dated 21.11.2022 and order of sentence dated

24.11.2022 passed by the court of learned Additional Sessions
Patna High Court CR. APP (SJ) No.176 of 2023(8) dt.18-04-2025

Judge-VI-cum-Special Judge (POCSO), Muzaffarpur, in connection

with POCSO G.R. No. 39/2018 arising out of Ahiyapur P.S. Case

No. 481 of 2017, whereby and whereunder the appellant has been

convicted for the offences punishable under sections 376/511 of the

Indian Penal Code (in short ‘IPC’) and sections 8 and 10 of the

POCSO Act and sentenced for the said offences.
