This application for bail under Section 483 of BNSS (439 of

Cr.P.C.) has been filed by the petitioner who has been arrested in

connection with F.I.R. No.114/2024, registered at Police Station

Sadar Barmer, District – Barmer, for the offences under Sections

8/15, 17, 18 & 29 of the NDPS Act.

Heard learned counsel for the petitioner and learned Public

Prosecutor. Perused the material available on record.

Learned counsel for the petitioner submits that the petitioner

has been falsely implicated in the present case. Learned counsel

further submits that as per the NDPS Act, the commercial quantity

of narcotic contraband – Opium and Doda Post is 2.500 kg and 50

kg respectively, however, the allegedly recovered narcotic

contraband – Opium milk weighing 1.890 kg and opium weighing

270 gm and Doda Post weighing 1 kg, from the house of co-

accused Pankaj @ Pankiya @ Om Prakash are below the

commercial quantity. Learned counsel for the petitioner submits

that as per the prosecution story the said narcotic contraband was

supplied to co-accused Pankaj @ Pankiya @ Om Prakash by the

co-accused Deepak and Kanhaiya Lal. The co-accused Deepak

and Kanhaya Lal disclosed in their statement that the said narcotic

contraband was supplied to them by the co-accused Jeevan Singh.

The present petitioner Narayansingh was connected in this case on

the basis of the statement of Jeevan Singh that the present

petitioner has supplied the narcotic contraband to him.

Learned counsel for the petitioner submits that the co-

accused Jeevan Singh, Deepak, Kanhaiya and Pankaj @ Pankiya @

Om Prakash have already been enlarged on bail by a Coordinate

Benches of this Court vide orders dated 26.06.2024, 30.07.2024

and 20.08.2024, passed in S.B. Criminal Misc. Bail Application

No.7832/2024, 7465/2024 & 10656/2024 respectively.

Learned counsel for the petitioner further submits that the

petitioner is in judicial custody since 06.06.2025 and the trial of

the case will take significant time, therefore, the benefit of bail

may be granted to the accused-petitioner.

Per contra, learned Public Prosecutor has opposed the bail

application and submitted that although, the recovered

contraband is below commercial quantity but the petitioner is

having two previous criminal antecedent of NDPS Act.

Having considered the rival submissions, facts and

circumstances of the case and perused the record; considering the

fact that the narcotic contraband recovered in this case is below

commercial quantity and the petitioner is in judicial custody since

06.06.2025, without expressing any opinion on merits/demerits of

the case, this Court is inclined to enlarge the petitioner on bail.

Consequently, the bail application under Section 483 of BNSS

(439 Cr.P.C.) is allowed. It is ordered that the accused-petitioner

Narayansingh Solanki S/o Shri Bharatsingh @

Bhaaratsingh, arrested in connection with F.I.R. No.114/2024,

registered at Police Station Sadar Barmer, District – Barmer, shall

be released on bail, if not wanted in any other case, provided he

furnishes a personal bond of Rs.1,00,000/- and two sureties of

Rs.50,000/- each, to the satisfaction of learned trial court, for his

appearance before that court on each & every date of hearing and

whenever called upon to do so till completion of the trial.
