Heard on I.A.No.12599/25, which is an application filed under Section
338(2) of BNSS for assisting the prosecution.
2. After due consideration, the application is allowed. Shri Hemant Singh
Rana and his associates are permitted to assist the Public Prosecutor.
3. Heard on I.A No. 12766/2025, which is an Ad-interim application
seeking grant of interim bail on behalf of the applicant to secure medical treatment
of his eyes at AIIMS, New Delhi.
4. Vide order dated 25/06/2025, learned State counsel was directed to seek
instruction on the point as to whether medical treatment for the ailment of the
applicant is available in jail or at Gwalior.
5. In response of the aforesaid order, learned State counsel has produced
communication dated 27/06/2025 issued by Jaya Arogya Hospital, Gwalior,
wherein, it has been reported that the applicant is suffering from Diabetes, High
Blood Pressure, Hypothyroidism and the treatment for aforesaid ailments is

available at Gajra Raja Medical College, Gwalior. Applicant is also suffering from
cataract in both eyes with moderate N.P.D.R. ailment and the medical treatment
for the said disease is also possible at Jaya Arogya Hospital, Gwalior. The report
dated 27/06/2025 further states that for all the ailments, applicant is receiving
medical treatment at Jaya Arogya Hospital, Gwalior.
6. Taking into consideration the fact that Medical Board has given opinion
that the applicant has administered adequate medical treatment and the required
treatment is available for him at Jaya Arogya Hospital, Gwalior, I.A No.
12766/2025 is hereby rejected with direction to the State / Jail Authorities to
ensure proper medical treatment to the ailment being suffered by the applicant in
the Hospital as stated in the report dated 27/06/2025.
7. Also heard on the main application which is the third repeat bail
application filed by the applicant under Section 439 Cr.P.C./483 of the BNSS
seeking grant of regular bail in connection with Crime No.13/2024 registered at
Police Station Gijoura, District Gwalior (M.P.) for alleged commission of offences
under Sections 302, 307, 294, 34 of IPC and Section 25, 27 of Arms Act.
8. Learned counsel for the applicant submits that he has been falsely
implicated in the case. He has not committed any offence. As per the case of the
prosecution, the applicant along with other co-accused armed with firearm has
caused gunshot injury to one Satendra who has suffered the injury in his
skull. The counsel appearing for the applicant further submits that he is about 70
years of age suffering from various ailments and is lodged in jail since 6.6.2024,
therefore, the applicant is entitled for grant of regular bail.
9. On the other hand, learned counsel appearing for the State as well as
counsel appearing for the complainant oppose the bail application and submit that

the co-accused namely Ramniwas @ Ravi against whom the allegation was only
of snatching the mobile from the complainant has approached this Court in
M.Cr.C. No.21056/2025 and the coordinate Bench of this Court vide order dated
13.05.2025 has rejected the bail application of co-accused Ramniwas. It is further
submitted that the case of the present applicant is on worst footing than co-accused
Ramniwas in as much as he is having the allegation of causing firearm injury to
the injured Satendra and therefore, he is not entitled for grant of regular bail.
10. Considered the rival submissions of the parties and perused the case
diary.
11. Taking into consideration the totality of the circumstances and the fact
that the regular bail of the co-accused Ramniwas in the matter has been considered
and rejected by the coordinate bench of this Court on merits, this Court is not
inclined to extend the benefit of regular bail to the applicant. The same stands
rejected. However, as stated above it is reiterated that the State / Jail Authorities
to ensure proper medical treatment to the ailment being suffered by the applicant
in the Hospital as stated in the report dated 27/06/2025.
