1. The instant interim bail application has been filed under

Section 439 Cr.P.C on behalf of the petitioner, who is in judicial

custody in connection with F.I.R. No.136/2024 dated 09.06.2024

registered at Police Station Sameja Kothi, District Anoopgarh, for

the offence under Sections 8/21, 25 & 29 of the NDPS Act.

2. Learned counsel for the petitioner submits that the present

interim bail application has been filed on the ground that the

petitioner’s wife is suffering from a gynecological problem, which

is critical and requires surgery.

3. In compliance with the order dated 29.01.2025 passed by a

co-ordinate Bench of this Court, the learned Public Prosecutor has

procured the factual report dated 27.05.2025. The report dated

27.05.2025 is taken on record.

4. Upon perusal of the said factual report, it is reflected that a

Medical Board was constituted, and after examining the wife of the

petitioner, the Medical Board opined that she is suffering from

back ache and pain in her shoulders, for which she has been

prescribed certain medicines and no serious ailment was found.

5. Taking into consideration the opinion of the Medical Board

that there is no serious ailment from which the petitioner’s wife is

suffering, the petitioner is not required to be enlarged on interim

bail.

5. Accordingly, the present interim bail application is dismissed.
