The instant complaint is filed by the complainant
against the accused under Sec.200 of Cr.P.C. for the
offence punishable under Sec.138 of N.I Act to punish the
accused in accordance with law and pass an order for
payment of cheque amount of Rs.1,20,000/- to
complainant in the interest of justice and equity.
2. The brief facts of the case of the complainant is that:
It is submitted that, the accused is known to
complainant since 2018. Taking advantage of the same, on
04.12.2019, the accused had approached and requested
the complainant for hand loan of Rs.1,20,000/- to fulfill
his legal necessities. Considering the request of accused,
the complainant had paid a sum of Rs.1,20,000/- to the
accused by way of cash on 10.01.2020, while borrowing

the said amount, the accused assured to repay the same
within ten months.
