[1] Heard Mr. Y. Nirmolchand, learned senior counsel
assisted by Mr. L. Raju, learned counsel for the petitioner.
[2] Issue notice. [3] Mr. A. Jagjit, learned counsel accepts notice on behalf of
all the respondents. Hence service is complete on all the respondents.
[4] Mr. Y. Nirmolchand, learned senior counsel for the
petitioner, submits that the limited prayer of the petitioner is
readjustment of 4 (four) polling stations from Lamsang Assembly
Constituency to Uripok Assembly Constituency as the said polling
stations are surrounded by Uripok Assembly Constituency. In this
regard, the petitioner submitted representations dated 02.12.2002,
23.04.2003 and 09.12.2024 to the Chairperson, Delimitation
Commission of India (ECI)/respondent No. 2. It is stated that writ
petition may be disposed of at this stage by directing the authority to
decide the representation dated 09.12.2024 on merit by a speaking
order.
[5] Mr. A. Jagjit, learned counsel for the respondent, submits
that provisions of Section 8A of the Representation of Peoples Act,
1950 is under challenged and he may be permitted to take instruction
in this regard.
[6] List this case on 16.04.2025 for taking instruction and
filing counter affidavit, if any.
