The petitioner is aggrieved of a complaint preferred by the respondent
in the Court of Judge Small Causes, Judicial Magistrate 1st Class, Srinagar [”
the trial court”] under Section 138 of the Negotiable Instruments Act on 10 th
May 2024 and consequent issuance of process by the said Court on the same
day, primarily on the ground that he is a resident of Delhi, outside the
territorial jurisdiction of the trial court and under the circumstances, learned
trial court was mandatorily required to postpone the issuance of process in
terms of sub-Section 1 of Section 202 of the Code of Criminal Procedure. He
seeks to place reliance upon suo-moto writ petition (Crl.) No. 02/2020, titled
“Re. Expeditious Trial of Cases under Section 138 of the Negotiable
Instruments Act, 1881.”
