2. The petitioner has been made accused in connection with
Barkakana Rail P.S. Case No. 22/2007 corresponding to G.R. Case No.
128/2007, for the offences registered under Sections 147, 148, 149,
341, 323, 326, 307, 353 & 379 of the I.P.C., Section 27 of the Arms Act
and Section 17 C.L.A. Act, pending in the Court of learned Railway
Judicial Magistrate, Daltonganj, Palamau.
3. It was submitted that petitioner is not named in the F.I.R. It was
further submitted that name of the petitioner has transpired in
confession of co-accused. It was finally submitted that similarly
situated Anshu Yadav has been granted bail by a co-ordinate bench of
this Court.
4. In view of the submissions made above, I am inclined to release
the petitioner, on bail. Accordingly, the petitioner, named above, is
directed to be released on bail on furnishing bail bond of Rs. 20,000/-
(Rupees Twenty Thousand) with two sureties of the like amount each,
to the satisfaction of learned Railway Judicial Magistrate, Daltonganj,
Palamau in connection with Barkakana Rail P.S. Case No. 22/2007
corresponding to G.R. Case No. 128/2007.
