Supreme Court – Daily Orders
Ombir Singh vs State Govt. Of Nct Of Delhi on 28 July, 2025
1 IN THE SUPREME COURT OF INDIA CRIMINAL APPELLATE JURISDICTION CRIMINAL APPEAL No. of 2025 (Arising out of SLP(Criminal) No.5324/2025) OMBIR SINGH Appellant(s) VERSUS STATE GOVT. OF NCT OF DELHI Respondent(s) O R D E R
1. Leave granted.
2. Heard the learned Senior Counsel appearing for the
appellant and the learned ASG appearing for the
respondent.
3. The present appeal arises out of the impugned order
dated 21.02.2025, passed by the High Court of Delhi in
Bail Application No. 4031 of 2024, whereby, the High
Court has dismissed the said bail application filed by
the appellant seeking regular bail, in connection with
the FIR No. 430/2023 registered at Police Station-GTB
Enclave for the offences punishable under Sections 304-B,
498-A,406 and 34 of the Indian Penal Code, 1860.
4. Learned Senior Counsel appearing for the appellant
submitted that some of the other co-accused have already

been granted bail by the concerned Courts.
Reason:
5. Learned ASG appearing for the respondent has
vehemently opposed the grant of bail to the appellant by
2
submitting that the allegations against the appellant,
are very serious and the prayer for bail needs to be
rejected.
6. Admittedly, the appellant is the father-in-law of
the deceased, and has been under incarceration nearly for
roughly one year and 11 months, and only 08 out of 22
witnesses have been examined before the Trial Court so
far.
7. Considering the aforesaid and the submissions made
by the learned Senior counsel for the appellant, we are
inclined to set aside the impugned order.
8. Accordingly, the impugned order stands set aside
and it is directed that the appellant be released on
bail, subject to such terms and conditions that may be
imposed by the Trial Court.
9. The appeal is, accordingly, allowed.
10. Pending application(s), if any, shall stand
disposed of.
