The complainant has filed the present complaint
U/Sec.200 of Cr.P.C., alleging that the accused has
committed the offence punishable U/Sec.138 of Negotiable
Instruments Act (herein after referred as N.I.Act).

2. The case of the complainant in brief is as follows:-

The complainant and accused were known to each other.
As such, the accused approached the complainant during
the month of January 2016 for financial assistance of

Rs.6,00,000/-. As per the request made by the accused, in
the 1st week of January 2016, the complainant has paid the
same to the accused and the accused has also promised to
repay the said amount within 5 months. But after the lapse
of stipulated time, the accused has not repaid the hand loan
amount and towards the discharge of his liability has issued
a cheque bearing No. 065966 dated 16.05.2016 for a sum of
Rs.6,00,000/- which is drawn on State Bank of India,
Jalahalli west brach, Bangalore and assured that the cheque
will be honoured on presentation.
