1. Leave Granted.

2. The present appeals have been filed by the appellants

against an order dated 16.08.2021 passed by the Madras High

Court, dismissing the appellants’ Crl. O.P. No. 11094 of

2021 filed under Section 482, Code of Criminal Procedure,

19731 for quashing FIR Crime No. 28 of 2020.

3. The facts, to the extent that they are relevant for the

purpose of disposing of the present appeals are as follows.

The appellant-P. Murali and respondent no. 2 were partners

in a firm, duly reflected in partnership deed. Allegedly,

parties entered into a codicil whereby appellant-P. Murali

was allowed to operate the bank account of the partnership

firm. The appellant-P. Murali has allegedly transferred

funds out of the concerned account for his own benefit,

compelling respondent no. 2 to lodge an FIR on 28.02.2020

against the appellant-P. Murali and his son alleging

offences under Sections 420, 465, 468, 471, read with

Sections 34 and 109 of the Indian Penal Code, 1860.
