            WRIT PETITION No.22419 OF 2025

ORDER :

Heard Sri Mohammed NazeeruddinKhan, learned

counsel for the petitioners and Sri B.Sridhar, learned

Government Pleader for Home,.

2. This Writ Petition is filed to declare the action of

the respondent/police in interfering with civil disputes

by harassing the petitioners under the guise of

investigation in Crime No.294 of 2024 on the file of

Mahbubnagar Town II Police Station, without following

the due procedure laid down under law, as illegal.

3. Whereas, Sri B.Sridhar, learned Assistant

Government Pleader for Home, on instructions, would

submit that the petitioners are habitual offenders and

the following four caes have been registered against

them.

i) Cr.No.26/2024 under Sections 420, 406, 467,

468, 471 IPC of EOW, Cyberabad Police Station.

ii) Cr.No.464/2024 under Section 420, 406, 467,

468 IPC of KPBH Colony Police Station.

iii) Cr.NO.240/2021 under Sections 448, 420, 452,

406, 506 and 120-B IPC on 26.03.2021.

iv) Cr.No.370/2024 under Sections 420, 465, 467,

468 IPC of Kukatpally Police Station.

He further submits that in Cr.No.370 of 2024,

pending on the file of Kukatpally Police Station, there

are serious allegations against the 1st petitioner that he

has forged the signature of learned Principal Senior Civil

Judge, Bapatla, prepared a show-cause notice and

served it on the defacto complainant thereon, who is

Smt.Guddeti Vani Sree, W/o.G.Murali Sagar Kumar.

There are also serious allegations against both the

petitioners that they are cheating innocent people under

the guise of black magic and inducing them to transfer

properties and parting with valuables and cash of

Rs.2.00 Crores. The details of the registered sale deeds

are as follows:

dated 24.02.2023( Sub-Registrar, Addakal)

3. Registered sale deed document No.1194/2023,
dated 04.02.2023 (Sub-Registrar, Rajender
Nagar, Hyderabad)

4. Registered sale deed document No.2007/2023,
dated 04.03.2023 (Sub-Registrar,
Serilingampally, Hyderabad)

4. Learned Assistant Government Pleader for

Home has produced written instructions of 4th

respondent. In the said written instructions, there is

also specific mention that the Investigating Officer in

the said crime has not seized passport of petitioners,

as alleged by them in the writ affidavit.

5. Petitioners herein have also filed a petition

under Section 528 of BNSS vide Criminal Petition

No.7282 of 2025 to quash the proceedings in Crime

No.294 of 2024 dated 05.10.2024 on the file of 4th

respondent herein. Considering the fact that the

punishment prescribed for the offences alleged

against the petitioners is below seven years and also

the submission made by the petitioners that they

will cooperate with the Investigating Officer, vide

order dated 17.06.2025, this Court disposed of the

said Writ Petition directing the petitioners to appear

before the 4th respondent, within one week from the

date of receipt of a copy of the said order. Upon such

appearance, the Investigating Officer shall issue

notice to the petitioners under Section 35(3) of the

BNSS, in connection with Crime No.294 of 2024,

and shall proceed further strictly in accordance with

the guidelines laid down by the Hon’ble Supreme

Court in Arnesh Kumar v. State of Bihar [(2014) 8

SCC 273)] and petitioners shall cooperate with the

Investigating Officer during the course of

investigation.

6. Learned Assistant Government Pleader for

Home, on instructions, would submit that despite

the said direction, the petitioners did not appear

before the Investigating Officer within one week.

However, they have appeared only on 22.07.2025.

They were directed to appear on the next day i.e.,

23.07.2025. The Investigating Officer has already

served notice under Section 35(3) of the BNSS on the

petitioners. Petitioners fled away on the ground of

medical emergency. They are not cooperating with

the Investigating Officer.

7. In the light of the above discussion, this Writ

Petition is disposed of directing the petitioners to

cooperate with the Investigating Officer in the

subject crime and the Investigating Officer in the

said crime shall follow the directives issued by this

Court vide order dated 17.06.2025 in Criminal

Petition No.7282 of 2025. If the petitioners failed to

cooperate with the Investigating Officer, liberty is

granted to the Investigating Officer to take steps

against the petitioners, in accordance with law.

As a sequel thereto, the miscellaneous petitions, if

any, pending in the Writ Petition shall stand closed.
