Cr. Appeal No. 46 of 2016/152 of 2017, whereby the judgment

of conviction and order of sentence passed by learned J.J.

Board, Samastipur has been upheld.

Factual Background

2. The factual background of the case is that on the

basis of the fardbeyan of the victim/minor girl dated 03.03.2011,
Patna High Court CR. REV. No.819 of 2019 dt.07-07-2025

Khanpur P.S. Case No. 36 of 2011 was registered on 03.03.2011

against the petitioner and the co-accused/Fulo Kumar for the

offence punishable under Section 376(2)(g) of the Indian Penal

Code.

3. At the stage of investigation, both the accused

persons took plea of juvenility. Hence, their records were

transferred to the J.J. Board, Samastipur. However, after

investigation, charge-sheet was submitted only against the

petitioner finding the co-accused innocent. However, during

juvenile inquiry, the co-accused was summoned under Section

319 Cr.PC. But, the record of the co-accused was subsequently

separated from that of the petitioner.
