ORDER:

This Criminal Petition, under Sections 480 and 483 of the Bharat’lya

Nagarik Suraksha Sanhita, 2023, has been filed by the Petit’lOner/A1,

offences under sections 20(b)(ii)(B), 25 read with 8(c) of the NarcotI|C Drugs

and Psychotropic substances Act.

3. case of the prosecution, in brl’ef, I-Sthat, on 10.4.2025 at 12.00 noon,

on receipt of credible informat]-on regarding illegal possession and

transpor{atl’on of ganja, the s.I of PoI]|ce, along with staff and mediators

rushed inside Adwani parkJ near Harbour police s{a{ion, Kobbaritho{a,

visakhapa{nam and found one person jn susp[‘cious cl-rcumstances by

holding a bag. on see[‘ng police, said person tried {o escape. Then po[jce

apprehended said person who is child in conflict with Law. on

interrogat]Lon, he d[-sclosed his identity particulars as accused and police

seized 1.280 kgs of ganja from his possession. He confessed the

involvement of Al jn transportat[|on of the ganja. police seized the

contraband, arrested the accused and got hI’m remanded to judicial

custody/J’uVenile home. Pol[|ce arrested the pe{I’tjOner on 25.4.2025 and

since then the petitioner is in judicial remand.

4. Heard learned counsel for the petitioner and learned Assistant public

prosecutor appearing on behalf of the respondent-s{a{e. perused the

record.

5. Learned Assistant public prosecutor submits that the court may pass

appropriate Orders.

6. A perusal of the material available on record goes to show that the

petitioner was arrested and remanded to judicial custody on 25.4.2025.

Police on credible information seized 1.280 kgs of ganja from the other

accused. pursuant to the confessional statement of co-accused, the

petitioner was arrested. No incriminating material has been seized from the

petitioner to connect the petitioner with the crime. Basing on the

confessional statement of co-accused, the petitioner has been arrested and

remanded to J-udiCial custody.-

7. ln view of the aforesaid facts and circumstances of the case, this
court is inclined to grant bail to the petitioner/Al herein, on the following

conditions.

(i) The petitioner/Al herein shall be released on his executing a
personal bond for Rs.10,.000/-(Rupees ten thousand only) with two
sureties for a like sum each’to the satisfaction of the ‘learned I
Additional District and Sessions Judge-Gum-Special Judge for Trial of

Offences Under NDPS Act, Visakhapa,tnam;

(ii) On release, the petitioner shall appear before- the Station House
Officer concerned once in a week i.e. on every sunday between 10.00
a|m. and o5.00 p.m., till filing of charge sheet.

8. Accordingly, the Criminal Petition is allowed.
