Per, S. Chandrashekhar, J:
Challenging the order dated 24th January 2025 passed in
O.A. No.34/2014 with M.A. No.122/2016 titled “Smt. Pappu Devi
v. U.O.I. & Ors.”, the mother of Kuldeep Kumar Sen, the deceased
[2025:RJ-JD:28208-DB] (2 of 5) [CW-10891/2025]
employee has filed the present Writ Petition. The Tribunal dealt
with the plea raised on behalf of the petitioner that she is also
entitled for a part of pension / family pension on death of her son
in the following lines:-
“5. Perusal of record reveals that the son of the applicant,
Corporal Kuldeep Kumar Sen, died on 25/2/2014 at his home
town while on casual leave owing to sudden Cardiac Arrest. Court
of Inquirty that had gone into circumstances under which the son
of the applicant died opined his death as not attributable to Air
Force service. In accordance with policy in vogue, Smt. Dimple,
wife of the deceased soldier being the highest eligible heir, was
granted Family Pension and Death-cum-Retirement Gratuity.
Moreover, the deceased Corporal K.K. Sen has never executed
any ‘Will’during his service period.
