By way of the instant Civil Writ Petition, the petitioners have

sought the indulgence of this Court for the issuance of a writ in the nature

of mandamus directing respondents No.1 to 4 to receive and entertain the

Election Petition, as intended to be filed by them and also to decide the

same, as per the provisions of the Punjab State Election Commission Act,

1994.

2. Mr. S.S. Hira, learned Deputy Advocate General, Punjab, has

put in appearance on behalf of respondents No.1 to 4 in this case in

pursuance of the copies of the present petition having been sent to the

respondent-State, in advance.

3. Learned counsel for the petitioners relies upon the order

passed by the Co-ordinate Bench on 19.12.2024 in CWP No.34623 of 2024

titled as “Gurdev Singh Versus State of Punjab and others” and submits

that along-with the Election Petition, the petitioners would move an

appropriate application for seeking condonation of the delay in filing the

afore-said Election Petition and he prays that the instant writ petition be

also disposed of in view of the above-referred order dated 19.12.2024.

4. Learned State counsel has no objection for the same.

5. Resultantly, the Civil Writ Petition in hand is, hereby,

disposed of with the direction to the concerned Election Tribunal to receive

the Election Petition and also the application that may be moved by the

petitioners therewith, for seeking condonation of the delay in filing the

same (Election Petition) and to proceed to adjudicate the afore-mentioned

application and thereafter, expeditiously decide the above-referred Election

Petition as well, in accordance with law.
