03.         1.         The petitioners by invoking inherent jurisdiction

of this Court under Section 482 Cr.P.C. are seeking
quashing of CDA Phase-II P.S. Case No.67 of 2024
corresponding to G.R. Case No.436 of 2024 for the
alleged commission of offences punishable under
Sections 120-B/294/323/351/504/506/509 of the IPC.

2. Notice was issued to the State Counsel to seek
instructions regarding status of the investigation of the
present case, vide order dated 10.12.2024. Pursuance
thereto, the State Counsel submitted the written

instructions he has received from the IIC, CDA Phase-II,
Police Station, which reads as under:-

“With reference to the letter and subject cited
above I have the honour to report that on
08.05.2024, IIC CDA Phase-II Police Station
received a letter vide Memo No.719 (2) dated
08.05.2024 from the Hon’ble Corut of JMFC-I
(Cog. Taking), Cuttack where the petitioner Lalit
Muraka filed a case vide 1CC Case No.47/2024
and on the complaint of the petitioner Lalit
Muraka, IIC registered CDA Phase-II PS Case
No.67/24, U/S-294/323/351/504/ 506/509/
120-B IPC and investigated by SI B.D. Jena.
After completion of investigation, IO, SI B.D.
Jena submitted the Final report as Mistake of
facts on 26.10.2024.”

3. In view of the aforementioned instructions, since
the final form has already been filed by the investigating
police, nothing survives in the present case.

4. Accordingly, the CRLMC is disposed of.
