Patanjali’s Dant Kanti Packaging Too Close to Dabur Red? Court to Decide

The Delhi High Court has been informed that mediation between Dabur India Limited and Patanjali Ayurved Ltd has failed in their ongoing trademark and trade dress dispute over Patanjali’s “Dant Kanti Red (pan flavour)” toothpaste.

Dabur alleges that Patanjali’s packaging closely imitates the trade dress of Dabur Red, potentially misleading consumers. While Dabur does not object to the use of the term “Red” or the “pan leaf” symbol, it claims the new packaging—introduced in December 2024—copies its product’s overall appearance.

Justice Manmeet Pritam Singh Arora recorded that pre-institution mediation under Section 12A of the Commercial Courts Act, 2015 had been satisfied and exempted Dabur from initiating another mediation round, noting the grounds for interim relief. The case is now listed for further hearing in December 2025.

This dispute follows Dabur’s earlier disparagement suit over a Patanjali advertisement featuring Swami Ramdev, which questioned the authenticity of competing Chyawanprash products. In July 2025, the Court ordered Patanjali to withdraw those ads.
