In Re:- An application for anticipatory bail under
section 482 of the Bharatiya Nagarik Suraksha Sanhita,
2023/under Section 438 of the Code of Criminal Procedure.
In connection with Kharagpur police station case no. 275 of
2025 dated 9.6.2025 under sections 316(2)/318(2) of the
BNS.
In the matter of: Piu Roy
... Petitioner
Mr. Subhadeep Chatterjee
Ms. Arpita Kundu
...for the petitioner.
Ms. Antariksha Basu
Ms. Ratua Ghosh
...for the State.
1.
Heard the learned counsels for the parties.
2. Perused the case diary.
3. Considering the serious nature of allegations and the
materials available in the case diary including the FIR
which states that the de-facto complainant, a Police
Constable, had allegedly paid sums of money to the
petitioner on good faith, I do not think that the custodial
interrogation of the petitioner is required in this case and
I am inclined to grant anticipatory bail to the petitioner.
4. In the event of arrest, the petitioner shall be released on
bail upon furnishing a bond of Rs.10,000/- each with two
sureties of like amount each, one of whom must be local,
to the satisfaction of the Arresting Officer and also be
subject to further conditions that the petitioner shall
2
cooperate with the investigation and the petitioner shall
not threaten or intimidate witnesses.
5. Accordingly, the application for anticipatory bail is
allowed.
6. Urgent photostat certified copy of this order, if applied for,
be given to the parties upon compliance with requisite
formalities.
