2. During the pendency of the present special
leave petitions, with the consent of the parties,
the matters were referred to the Supreme court

Mediation Centre vide order dated 11.02.2025 for
exploring the possibility of an amicable
settlement.
3. The parties have entered into a settlement
and the Settlement Agreement dated 26.03.2025 has
been brought on record.
4. In terms of the aforesaid settlement, a
joint application bearing I.A. No. 120461 of 2025
seeking dissolution of marriage between the parties
by a decree of divorce on the basis of mutual
consent has been filed under Article 142 of the
Constitution of India and it has been stated that
their marriage has been irretrievably broken down
and they have been living separately for the last
more than three years.
5. Under the settlement, the parties have inter
alia agreed to dissolve their marriage by a decree
of divorce subject to the respondent-husband paying
a lump sum amount of Rs.15,00,000/-(Rupees fifteen
lakhs) to the petitioner-wife as full and final
settlement of all her claims regarding Stridhan,
maintenance and permanent alimony. They have also
agreed that they will withdraw all the cases filed
by each one of them, once a decree of divorce is
passed either under Article 142 of the Constitution

of India or by the Family Court.
6. It has also been agreed that all civil and
criminal cases pending between the parties shall
stand closed, namely:
“i. Case No. 5657/2024 CRA pending
before Indore High Court of Madhya Pradesh
at Indore titled as “X Vs. State of Madhya
Pradesh & Ors.”;
ii. Case No. 7939 of 2024 RCT pending
before 3rd Additional Judge I CJ, Gwalior,
M.P., titled as “Suresh Babu Arya Vs. Akash
Verma”;
iii. Case No. 332 of 2023 RCT pending
before 3rd Civil Judge Civil Division
Mandsaur, titled as “State Vs. Mayank
Bagoriya”;
iv. Maintenance case U/s 125 Cr.P.C.
bearing No. 894/2022 MJCR pending before
Family Court, Gwalior, Madhya Pradesh,
titled as “Pooja Garothiya Vs. Jitendra @
Jeet”;
v. Case No. 921/2024 MJCR pending
before Family Court, Gwalior, Madhya
Pradesh U/s 125(3) Cr.P.C. titled as “Pooja
Garothiya Vs. Jitendra @ Jeet” and;
vi. RCS H.M.A. No. 159 of 2023 filed by
the Respondent-husband pending before the
Ld. Principal Judge, Family Court,
Mandsaur, Madhya Pradesh.”
7. Learned counsel for the parties submit that
the entire amount of Rs.15,00,000/-(Rupees fifteen
lakhs) has already been paid to the petitioner-wife

along with an amount of Rs.45,000/-(Rupees forty-
five thousand) towards other jewellery articles.
8. Considering the fact that the marriage
between the parties solemnized on 23.01.2022 has
been irretrievably broken down and the parties have
agreed to live separately, we consider it proper to
exercise our power under Article 142 of the
Constitution of India and direct for drawing a
decree of divorce by mutual consent in RCS H.M.A.
No. 159 of 2023, titled as “Jitendra alias Jeet
Arya Vs. Pooja”, pending in the Court of Principal
Judge, Family Court, Mandsaur, Madhya Pradesh,
which shall stand closed accordingly.
9. Similarly, all other cases referred to above
shall also stand closed.
10. The parties shall remain bound by the terms
and conditions of the Settlement Agreement.
11. The application being I.A. No. 120461 of
2025 is allowed in the above terms and the special
leave petitions stand disposed of accordingly.
12. The Registry shall inform the respective
Courts about this order where the proceedings are
pending in the aforesaid cases.
13. We place on record our appreciation for the
sincere work done by the Supreme Court Mediation

Centre in facilitating the parties to arrive at an
amicable settlement.
14. Pending application(s), if any, shall stand
disposed of.
