1. Vide this judgment, this Court shall dispose of the present complaint filed by the
complainant Sh. Prabhu Dayal (hereinafter referred to as “the Complainant”) against Sh.
Sanjeev Kakkar (hereinafter referred to as “the Accused”) under Section 138 of the
Negotiable Instruments Act, 1881 read with Section 142 of Negotiable Instruments Act,
1881 (hereinafter referred to as “NI Act”).

2. It is the case of the complainant,
A. That, the complainant is working in the name and style of M/s Piyush and Company
Office and is engaged in the business of Govt. Contractor of Transport, Earth movers,
building material and water suppliers throughout Delhi NCR and all over India from the
above mentioned address. That, the complainant is the registered owner of the vehicles
bearing no.- HR63D0491, TATA 3718, Engine No.-63604396, Chassis No.-
MAT541024H3G16085 and vehicle bearing no.- HR63D5511, TATA 3718, Engine
