1. Heard Mr. M. K. Choudhury, learned Senior counsel assisted by Mr. A. V.
Singh, learned counsel for the petitioner. Also heard Ms. M. Kumar, learned
standing counsel, CBI.

2. This petition under Section 482 BNSS, is filed for granting the privilege of
pre-arrest bail to the petitioner, namely, Pradip Kumar Kasera, apprehending
arrest in connection with CBI/AC-II/New Delhi P.S. Case No.
RC2172025A0012 dated 03.05.2025 registered u/s 7,9,10 & 12 of the
PC Act, 1988(as amended) r/w Section 61(2) of the BNS, 2023.
3. It is submitted by Ms. M. Kumar, learned standing counsel, CBI that
charge-sheet has already been submitted in this case wherein the present
petitioner has not made an accused thereby indicating that no sufficient
material has been found during the investigation against the present petitioner.
4. On the other hand, Mr. Choudhury, learned counsel for the petitioner
submits that there is still some apprehension in the mind of the petitioner and
prays for confirmation of the interim order of pre-arrest bail.
5. Ms. M. Kumar, learned standing counsel, CBI has made a submission
regarding the maintainability of the instant application before this Court.
6. Having regard to the present development of the case culminating in the
submission of the charge-sheet without naming the present petitioner as an
accused, I do not consider it necessary to enter into the question of
maintainability.
6. Accordingly, the interim pre-arrest bail granted vide order, dated
15.05.2025 is hereby made absolute, subject to the following conditions-
(i) That the petitioner shall co-operate in future investigation is any
as and when required; and
(ii) That the petitioner shall not, directly or indirectly, make any
inducement, threat or promise to any person acquainted with the
facts of the case so as to dissuade him from disclosing such facts

8. This disposes off the anticipatory bail application.
