Heard Mr. Mrityunjay Kumar, learned counsel
appearing on behalf of the petitioners; Mr. Naresh Dikshit
along with Mrs. Kalpana, learned counsel for the BSEB and
Mr. Shiv Kumar, learned AC to GA 3 for the State.
2. Learned counsel appearing on behalf of the
petitioners seeks to modify the relief as prayed for in the present
writ petition and for the same, he prays for two weeks time.
3. Mrs. Kalpana, learned counsel appearing on behalf
of the Bihar School Examination Board and Mr. Shiv Kumar,
learned counsel appearing on behalf of the State also seeks
two weeks time to file comprehensive counter affidavit, giving
reason for not holding examination of Diploma in Elementary
Education (D.El.Ed.) Face-to-Face (Regular Course) second
time, as the petitioners are aggrieved by such action, because

they have been terminated for having not become successful in
the first attempt and they have not been given second chance to
take up the examination.
4. Considering the grievance of the petitioners in the
present writ petition, the Additional Chief Secretary, Education
Department, Government of Bihar is directed to give the detail
particulars relating to each petitioners in respect of their date of
appointment and educational qualification on or before
31.03.2019 and also give reason for not holding examination of
Diploma in Elementary Education (D.El.Ed.) Face-to-Face
(Regular Course) second time. He must also clarify, as to
whether, before the petitioners and similarly situated teachers
were terminated, any opportunity of hearing was afforded to
them or not.
5. As prayed for, re-notify the writ petition on
20.03.2025.
