Learned counsel for the petitioner submits that petitioner is

not an encroacher over the Government land rather then, he has

possession in the land in question under the Patta issued by the

Gram Panchayat Dhod, District Sikar (Rajasthan) on 24.06.1965 in

favour of the father of the petitioner. Counsel submits that

petitioner is in lawful possession and notice dated 29.02.2024

issued under Section 91 of the Rajasthan Land Revenue Act, 1956

for removal of the possession from the land in question, is illegal.

It is submitted that under the garb of inquiry initiated under

Section 91 of the Rajasthan Land Revenue Act, rights of the

petitioner cannot be curtailed and his residential house

constructed on allotted land cannot be demolished. Counsel

submits that reply/representation along with relevant documents

has already been submitted before the concerned authority but till

date no decision has been taken on the reply/representation filed

by the petitioner.
