1 IN THE SUPREME COURT OF INDIA CRIMINAL APPELLATE JURISDICTION CRIMINAL APPEAL NO(S). 5070/2024 PRAKASH & ORS. APPELLANT(S) VERSUS THE STATE OF KARNATAKA RESPONDENT(S) O R D E R
1. The appellants stood charged for the offences under
Sections 498-A and 306 of the Indian Penal Code read with
Section 34 of the IPC and Sections 3, 4 and 6 of the
Dowry Prohibition Act, 1961 (hereinafter referred to as
‘the D.P. Act’). Accordingly, sentence of 4 years under
Section 306, 2 years under Section 498-A, 2 years under
Section 3 of the D.P. Act, and 6 months under Sections 4
and 6 of the D.P. Act, to run concurrently, has been
imposed by the High Court while modifying the sentence.
2. We have heard learned counsel for the appellants and the
respondent.

3. Upon hearing the counsel for the parties and on a perusal
of the judgment rendered by both the Courts, we find no

reason to interfere with the conviction. However, taking
into consideration the mitigating circumstances,
including the fact, that the occurrence has taken place
nearly two decades ago, and considering that the
appellant has already undergone some part of the
sentence, we are inclined to modify the sentence, while
confirming the conviction for all the offences, to the
one undergone already.
4. Accordingly, while confirming the conviction, we modify
the sentence to the one undergone already.
5. The appeal is accordingly partly allowed.
6. Pending application(s), if any, shall also stand disposed
of.
