1. Leave granted.

2. Heard learned counsel for the parties.

3. This appeal arises from a bail rejection order dated

28.01.2025 passed by the High Court of Judicature for

Rajasthan at Jaipur whereby the bail prayer of the appellant

in connection with FIR No.13/2024 has been rejected.

4. Having regard to the following : that the appellant is

in jail since 10.04.2024 in connection with a Magistrate

triable offence; there are multiple accused and 49 witnesses

are to be examined; and therefore, there is no likelihood of

the trial being completed in near future, we are of the view

that the appellant is entitled to be released on bail.

5. Consequently, the appeal is allowed. The impugned order

dated 28.01.2025 is set aside qua the present appellant.

6. The appellant shall be released on bail on such terms

1. Leave granted.

2. Heard learned counsel for the parties.

3. This appeal arises from an order dated 12.05.2025

passed by the High Court of Judicature for Rajasthan at

Jaipur rejecting the bail prayer of the appellant in

connection with FIR No.13/2024.

4. The allegation against the appellant as per the charge

sheet extract is that he arranged a forged certificate of

participation of his wife in a tug of war event. It appears,

using that certificate his wife – Suman Bhari has secured

appointment. Suman Bhari, herself is an accused and is

currently in jail.

5. The argument of the learned counsel for the appellant

is that both husband and wife are currently in jail; there

is a child to be looked after; the allegation against the

appellant is in respect of arranging a fake certificate for

his wife, therefore the possibility of the appellant

receiving any consideration for the same is remote; that a

large number of persons have been made accused in connection

with FIR No.13/2024 and as many as 49 witnesses are to be

examined in the trial; and the learned Magistrate handling

the trial has not been able to comply with the mandate of

Section 437(6) of the Code of Criminal Procedure (for short

‘the Cr.P.C.’). In such circumstances, the appellant is

entitled to be released on bail.

6. The learned counsel for the respondent-State submits

that the provisions of Section 437(6) of the Cr.P.C. are not

mandatory in nature and in the facts of the case, the

benefit of this provision may be denied.

7. Having regard to the submissions made as also that the

appellant has been incarcerated since 11.04.2024 in a

Magistrate triable offence, bearing in mind that the

likelihood of the trial being concluded in near future is

remote, we are of the view that the appellant is entitled to

be released on bail.

8. Consequently, the appeal is allowed. The impugned order

dated 12.05.2025 is set aside qua the present appellant.

9. The appellant shall be released on bail on such terms

and conditions as the Trial Court concerned may deem fit and

proper in the circumstances to impose.

10. Pending application(s), if any shall stand disposed of.
