The Court : The plaintiff resumes his argument in support of
his injunction application and concludes the same. In course of argument,
the plaintiff by referring to the chain of events and the judgment reported in
ILR Vol. XI page 566 (Kessowji Tulsidas and Another Vs. Hurjivan Mulji and
Shamkuvarvahu) submits that the Memorandum of Understanding (MoU)
dated 29th February, 2024 has been got executed by the plaintiff under the
threat of a criminal proceedings. The plaintiff was compelled to sign the
MoU as his son Aman Goel was in judicial custody pursuant to a complaint
made by the defendant no.1 (Ashok Goel) and his wife and the said
defendant no.1 was not willing to withdraw such complaint unless the MoU
was signed and a gift deed was executed. The gift deed being a fall out of the
MoU was also got executed by the plaintiff under coercion and duress and
is, therefor, an invalid document.
