1. Heard the learned counsel for the parties. Both

the parties are also present in the Court.

2. The parties have filed a joint application under

Article 142 of the Constitution of India for grant of

decree of divorce by mutual consent and the terms have

been set out in the Memorandum of Understanding dated 4th

May, 2025. It is mentioned therein that there was no

child born from the wedlock. As agreed, ₹ 9,00,000/-

(Rupees nine lakhs) were paid earlier to the petitioner-

wife and cheque No.000009 dated 31st July, 2025 in the

name of the petitioner-wife for ₹ 10,00,000/- (Rupees ten

lakhs) has been handed over today in the Court to the

petitioner-wife in terms of the Memorandum of

Understanding as full and final settlement of all her

3. As it is mentioned in paragraph (vii) of the

Memorandum of Understanding, gold articles have been

handed over by the respondent to the petitioner in the

Court and the petitioner has verified the same and found

them to be right.

4. It is mentioned in the application filed under

Article 142 of the Constitution of India that there are

6 cases pending between the parties, the details are

reproduced herein below:

Procedure

6. Divorce Petition bearing No.A/622/2024

5. As far as the Divorce Petition (S.No.6) is

concerned, as the decree is being passed by this Court

under Article 142 of the Constitution of India, the same

shall stand disposed of.

6. The cases at Sr.Nos. 1 to 3 were filed by the

petitioner and her parents. First two cases shall stand

withdrawn. The third case being FIR No.191 of 2024 and

the proceedings arising therefrom shall stand quashed.

7. As far as cases at Sl.No.4 and 5 filed by the

respondent and his family members are concerned, the same

shall stand withdrawn.

8. In view of settlement arrived at between the

parties, decree of divorce is passed by mutual consent.

The parties shall abide by the terms and conditions of the

Memorandum of Understanding dated 4th May, 2025, which

shall form part of the decree.

9. A decree shall be drawn in terms of this order.

10. A copy of this order be forwarded to the concerned

Courts to record disposal of the proceedings in the cases

noticed above.

11. Accordingly, the Transfer Petition is disposed of.
