Heard learned counsel for the petitioner and learned
APP for the State.
2. The petitioner seeks bail in connection with Chakia
P.S. Case No. 168 of 2023 instituted for the offences under
Sections 399, 402, 324, 326, 332, 333, 352, 353, 307 of the
Indian Penal Code and 25(1-b)a, 26, 27, 35 of the Arms Act
3. Prosecution case, in short, is that, on the basis of
secret information, police raided the place of occurrence. When
the police officials tried to catch the miscreants, the miscreants
fired upon the police officials due to which some of the police
officials sustained injuries. Further, police officials also, to save
themselves, fired upon the miscreants. It is further alleged that
four persons were apprehended after the firing had ceased. The

apprehended persons also disclosed that this petitioner who
succeeded in fleeing away from the spot has also fired upon the
police officials.
4. Learned counsel for the petitioner submitted that the
petitioner has falsely been implicated in the present case. The
name of the petitioner transpired in this case on the basis of
diclosure made by the co-accused person who was apprehended
on the spot. No incriminating article has been recovered from
the conscious possession of the petitioner. Learned counsel
further submitted that petitioner has got no concern with the
alleged offence. It has been submitted on behalf of the petitioner
that the petitioner is in custody since 10.02.2025 and has five
criminal antecedents. The co-accused person has already been
granted bail by this Court vide order dated 03.11.2023 passed in
Cr. Misc. No. 69672 of 2023.
5. Learned A.P.P. for the State has vehemently
opposed the prayer for grant of bail to the petitioner.
6. Considering the aforesaid facts and circumstances
of the case, claim based on parity as also the period of custody
undergone by the petitioner, this Court is inclined to grant bail
to the petitioner.
7. Let the petitioner be released on bail on furnishing
Patna High Court CR. MISC. No.46036 of 2025(2) dt.24-07-2025

bail bonds of Rs.10,000/- (Ten thousand) with two sureties of
the like amount each to the satisfaction of Court
below/concerned Court in connection with Chakia P.S. Case
No. 168 of 2023.
