1. The petitioner is in occupation of certain plots of land of the Shyama

Prosad Mookherjee Port since 1961. The dispute is with regard to the rent

that is payable.

2. There is an order passed by the Learned Additional District Judge, 10 th

Court, Alipore on 2nd December, 2024 in P.P. Appeal No. 21 of 2010

wherein the learned Court allowed the appeal filed by the petitioner on

contest by setting aside the impugned final order no.35 passed by the

Estate Officer directing eviction of the petitioner on account of non-

payment of rent and damages. The order of the Appeal Court has not been

challenged till date.

3. The Port authority on the teeth of the order passed by the Appeal Court

raised bill on 31st January, 2025 on the same rate that was set aside by

the Appeal Court. Even thereafter on 28th February, 2025 demand for

compensation for unauthorized use and occupation of Port Trust property

(compensation) has been raised.
