[1] Present Mr. L. Raju, learned counsel along with Ms. Y. Niha, learned
counsel for the petitioners; Mr. Y. Ashang, learned GA for the State respondents
and Mr. Kh. Lupenjit, learned counsel for the respondent no. 3.
[2] Vide order dated 03.06.2025, this Court permitted the petitioners to file
nomination for the election of the Governing Body of the 2(two) seats for the
parents/guardians of the students. However, it was made clear that the result of
the election could not be declared without the leave of this Court.
[3] The learned counsel for the respondent no. 3 submits that before
passing the interim order, scrutinizing of the 2(two) seats for the
parents/guardians of the students has already been completed by the petitioners
and as prayed that the respondent no. 3 may be permitted to do de novo
nomination and scrutinizing for the 2(two) seats of the parents/guardians of the
students including the nomination of the petitioners.
[4] The learned counsel for the petitioner has agreeable to the suggestions
made by the learned counsel for the respondent no. 3 and Mr. Y. Ashang, learned
GA for the State respondents submits that this Court may pass appropriate order
from the subsequent event as submitted by the learned counsel for the
respondent no. 3.
[5] Taking consideration of the subsequent development and the
submissions made at bar, the present writ petition is disposed of by permitting
the respondent no. 3 to conduct de novo election for 2(two) seats of the member
of the Governing Body for the parents/ guardians of the students as per rule.
[6] In the de novo election the candidature of the other candidate and also
of the 2 petitioners shall be considered as per rule.
[7] The respondent no. 3 is permitted to publish latest electoral roll for the
election of 2(two) seats of the Governing Body of the parents/ guardians of the
students.
[8] With these observations and directions, the present W.P. (C) No. 446 of
2025 is disposed of.
[9] Accordingly, the MC MC(W.P. (C)) No. 438 of 2025, MC(W.P. (C)) No.
445 of 2025 and MC(W.P. (C)) No. 460 of 2025 are also closed and disposed of.
[10] Interim order is merged with the final order. [11] Registry is directed to furnish a copy of this order to the learned counsel
appearing for the parties in the course of the day and also by whatsapp.
