1. This criminal complaint was filed by the complainant against the
accused under section 138 of the Negotiable Instruments Act, 1881.
(Hereinafter be referred to as the NI Act).
2. The case of the complainant is that the accused is known to the
complainant since last 7 years as the complainant and accused were

neighbour of each other. In the beginning of year 2020, the accused
approached the complainant for friendly loan of Rs. 1,50,000/- by
stating that his funds were stuck somewhere and he was in dire need of
funds and also promised to repay the amount within six months for
which he was proposing to borrow. Keeping the relations in mind, the
complainant agreed to give Rs. 1,00,000/- to the accused in cash without
any interest. After lapse of six months, the complainant requested the
accused to return the amount however, the accused started making false
excuses on one pretext or other. In the month of April 2023, when the
complainant was in urgent need of funds, he again requested the accused
to return his money but the accused was trying to linger on this in all
possible ways and manner.
