1. By way of this Transfer Petition, the petitioners

seek transfer of proceedings C.G.R. No.2327 of 2023, titled

“State vs. Akash Dubey & Ors.”, pending before the Court of

the learned Judicial Magistrate, Alipore District-South 24

Paragnas, West Bengal to the Court of the learned Chief

Judicial Magistrate, Jamshedpur, East Singhbhum District,

Reason: 2. The grounds raised by the petitioners for transfer

are: petitioners are at the apprehension of threat to their

life; petitioners cannot travel over a long distance of

more than 300 Kms; and the petitioners have not committed

any offence under Section 498A read with 34 of the Indian

Penal Code.

3. Issue notice, returnable on 02.09.2025.

4. Dasti service, in addition, is permitted. Let steps

for service be taken within two weeks.

5. In the notice itself let it be mentioned that the

respondents are required to file the counter affidavit

before the next date of listing.

seeks transfer of proceedings in Maintenance Case No.901 of

2023, titled “Ishani Elizabeth Singh vs. Akash Dubey”,

pending before the Court of the learned Judicial

Magistrate, Alipore District-South 24 Paragnas, West Bengal

to the Court of the learned Chief Judicial Magistrate,

Jamshedpur, East Singhbhum District, Jharkhand.

2. The grounds raised by the petitioners for transfer

are: petitioner is at the apprehension of threat to his

life; petitioner cannot travel over a long distance of more

than 2000 Kms; and prima facie the maintenance case against

the petitioner is not maintainable as the respondent is not

the legally wedded wife of the petitioner.

3. Issue notice, returnable on 02.09.2025.

4. Dasti service, in addition, is permitted. Let steps

for service be taken within two weeks.
